1. License Grant

FlashCardGratis grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the application on Apple-branded products that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. User-Generated Content & Responsibility

• Content Ownership: You retain complete ownership and intellectual property rights over any study materials, flashcard text, audio recordings, or images you create, attach, or import into FlashCardGratis.
• Compliance: You agree not to use FlashCardGratis to store or distribute content that violates applicable laws or infringes upon any third party's copyright, trademark, or intellectual property rights.
• Local Data Custody: Because all data is stored locally on your device, you are solely responsible for maintaining local backups of your collections using the built-in CSV export utilities.

3. Disclaimer of Warranties

FlashCardGratis is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the application will be uninterrupted, error-free, or free of bugs.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the developer or creator of FlashCardGratis be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the application, including data corruption, device loss, or data erasure resulting from app uninstallation or reset actions.

5. Apple Minimum Terms & Third-Party Beneficiary

You acknowledge and agree that:

• These terms are concluded between you and the developer of FlashCardGratis, not Apple Inc. Apple is not responsible for the application or its content.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to FlashCardGratis.
• In the event of any third-party claim that FlashCardGratis infringes intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

6. Termination & Changes

These Terms remain in effect until terminated by you (by deleting the application) or by us. We reserve the right to modify these Terms at any time. Any changes will be published directly to this URL with an updated effective date.
